New rule from BIS authorizes U.S. companies to more fully engage in international standards organiza
The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) has announced an amendment to the Export Administration Regulations (EAR) that will permit U.S. companies to more fully contribute to developing international standards in telecommunications. Previously limited by the participation of Huawei Technologies Co., Ltd. (Huawei), a sanctioned entity, in international standards organizations, U.S. companies can now release “certain technology to Huawei and its affiliates on the Entity List without a license if such release is made for the purpose of contributing to the revision or development of a ‘standard’ in a ‘standards organization.’”
The rule, published in the Federal Register (85 FR 36719), is effective 18 June 2020 and open for comments until 17 August 2020.
